Tool for determining surplus revenue in accordance with Section 16 StromPBG

To support system operators in calculating the surplus revenue, the four transmission system operators (TSOs) are providing a calculation tool for download below. This tool enables the system operator to determine the levy amounts offline in advance in accordance with the Electricity Price Brake Act and at the same time serves as a data container for uploading the input data to the portal of the respective TSO. For this purpose, the system operator uploads the tool completed for each month. The calculation algorithm of the tool is also mapped in the portals of the TSOs so that the amount of the levy is determined based on the plant-specific input values.

Data reporting (including feed-in time series, redispatch time series and price information for plant-related marketing) must be carried out exclusively using this tool!

The data reporting function in the respective TSO portal is expected to be activated in the course of June 2023. You will be requested to submit this data report by your responsible TSO in due course. If you wish to take any hedging transactions (Section 17 No. 1) or system-related marketing (Section 18) into account when determining the surplus revenue, supporting documents and evidence must be provided in addition to the data report in accordance with Section 17 No. 1 and Section 18 in conjunction with Section 29 StromPBG. Disclaimer

The Act on the Introduction of an Electricity Price Brake (StromPBG) came into force on December 24, 2022. Part 3 of the StromPBG regulates the absorption of surplus revenues. According to this, operators of electricity generation plants must pay the applicable levy to the distribution grid operator to whose grid their electricity generation plant is directly connected.

The plant-related data to be transmitted by operators of electricity generation plants to their transmission system operator responsible for the control area in accordance with Section 29 (1) StromPBG must be transmitted in accordance with Section 35 (4) sentence 2 StromPBG using the internet platforms set up by the transmission system operators.

The transmission system operators expressly point out that the operators of electricity generation facilities remain responsible for the proper calculation of the levy amounts in accordance with Part 3 of the StromPBG and the fulfillment of their notification obligations and other obligations under the StromPBG. The form templates provided by the transmission system operators in their respective control areas, the data portals and this Excel tool for calculating the levy amounts merely serve as an aid in this respect.

The transmission system operators are not liable for any damage that may arise from the use of form templates and their data portals (cf. Section 35 (6) StromPBG).

Information on the time schedule

03/2023 - Publication of calculation tool
The tool for calculating surplus revenues in accordance with Section 16 StromPBG is published on netztransparenz.de. System operators can familiarize themselves with the calculation algorithm and determine skimming results offline in advance.

From 04/2023 - Registration of system operators in the TSO portal
The TSOs will send a letter requesting system operators relevant to the levy to register in the respective TSO portal and to check the systems listed in the portal and, if necessary, to arrange clarification with the distribution system operator.

From 06/2023 - Request for data reporting (1st levy period)
The TSOs request the system operators to submit the data report for the first levy period.

The submission of the plant-specific data report (including the type of plant to be siphoned off, feed-in time series, redispatch time series and price information for plant-related marketing) is carried out exclusively via the Excel tool. Further information to be reported is requested directly in the TSO portal.

The tool's calculation algorithm is also mapped in the portal so that the input values are read from the tool during the upload and the levy amount is then calculated in the TSO portal.

The tool must be completed and uploaded for each individual month of the levy period (for the first levy period, at least four files must therefore be uploaded to calculate the surplus revenue).

As an alternative to the levy amount calculated in the portal, a specially calculated self-assessment amount can be claimed.

After complete data reporting, the system operators receive a receipt as a signed PDF for each distribution system operator, which serves as proof of successful data reporting to the distribution system operator.

The calculated levy amounts are also made available to the distribution system operator on a system-specific basis.

07/2023 - Deadline for submitting data reports
The statutory deadline for submitting the data report for the first levy period is July 31, 2023.

08/2023 -Payment due date
The payment due date for the first absorption period is 15.08.2023.

The exact payment modalities must be agreed with the responsible DSO.

From 09/2023 - Request for data reporting (2nd levy period)
The TSOs request the system operators to submit the data report for the first levy period.

10/2023 - Deadline for submitting data reports
The statutory deadline for submitting the data report for the second levy period is October 31, 2023.

11/2023 -Payment due date
The payment due date for the second levy period is November 15, 2023.
