§ Section 7(5) of the Combined Heat and Power Act (KWKG) states: "For periods in which the value of the spot market price pursuant to Section 3(42a) of the Renewable Energy Sources Act is zero or negative in the previous day's auction, the entitlement to payment of surcharges shall be reduced to zero."
