The EU Transparency Regulation

The EU Transparency Regulation (EU Regulation No. 543/2013) was introduced by the European Commission in 2013. It stipulates that certain data on electricity grids, electricity generation, electricity consumption and electricity trading must be reported and published. The aim of these publications is to promote efficient generation, consumption and trading decisions.

The market participants defined in the Transparency Regulation have been obliged to comply with their reporting and publication obligations since 2015.

Some data must be published almost in real time, every 15 minutes. This requirement makes it necessary for market participants to set up automated processes for data transmission and publication.

The data will be made publicly available free of charge on the ENTSO-E Transparency Platform.

Who is the target group?

The EU Transparency Regulation applies not only to transmission system operators (TSOs), but also to operators of power plants and storage facilities, large electricity consumers, distribution system operators and other market participants, such as electricity exchanges and auction offices for transmission capacities.

As the primary owners of data, these companies may be obliged to report certain data in accordance with the regulation. The reporting obligation depends on the capacity of the installations in the case of power plants and storage facilities, or on the level of electricity consumption in the case of large consumers.

Who has to report which data?

As the so-called primary owners of the data, the entities from which the data is generated (in addition to transmission system operators, these are operators of power plants or storage facilities as well as large electricity consumers) are generally obliged to report. The reporting obligation to the ENTSO-E transparency platform can be fulfilled by data reporting via the transmission system operators or by reporting via so-called data suppliers.

The following table lists the reports that operators of power plants or storage facilities and large consumers in Germany are obliged to publish.

Step-by-step guide to implementing the reporting obligation

In the following step-by-step guide, we will show you how to check whether you have to report data in accordance with the EU Transparency Regulation and how publication works:

1) Examination of the reporting obligation

Please check whether you, as a power plant or storage facility operator or as a consumer, are the primary owner of data subject to the reporting obligation under the EU Transparency Regulation.

2) Download the registration documents

If you are subject to registration, please download the documents provided further down on the page under "Documents for the registration of operators of power plants and consumers".

3) Checking the reporting-relevant data

Please use the EU Transparency Regulation to check the reporting obligations that apply to you.The reporting manual of the four TSOs provides you with additional information on the reporting obligations and also shows which reporting obligations the transmission system operators assume for you.

Publication obligations may exist in accordance with Articles 7 and 8 (consumers), Articles 14, 15, 16 (power plants and storage facilities), Article 17 (storage facilities) and Article 12 (electricity exchanges) of Regulation (EU) No. 543/2013.

4) Selection of a data supplier

Data is reported to the EU Transparency Platform via the so-called data provider. By virtue of the Regulation, your connection transmission system operator is deemed to be the regular data provider. However, you can also appoint a third party as a data provider. EEX and Nordpool are currently approved as data providers.

5) Filling out the registration form

Regardless of whether the connection transmission system operator or a third party data provider has been selected, central registration as a reporting primary owner in Germany with the connection transmission system operator is required. Please complete the registration form applicable to you in full, stating the selected data supplier, the objects relevant for reporting (production and generation plants or consumption units) and the relevant reporting data. Registration takes place per control area. If you operate plants in several control areas, please complete a registration form for each control area.

6) Submission of the registration form to the connection transmission system operator

Please submit the complete registration form to the connection transmission system operator. The submission can be made in electronic form, e.g. by e-mail. The contact details of your contact person can be found further down on this page.

7) Response to registration by your connection transmission system operator

Once your registration form has been successfully sent to your connection transmission system operator, they will contact you and coordinate the next steps.Further information on the following steps for implementing the notifications can be found in the notification manual.
